TERMS OF USE

The S Bell Training website (hereinafter referred to as the “Website”) is designed to provide you with the ability to purchase fitness equipment and high-quality videos of exercise classes and information about fitness and wellbeing. This Website is not directed to persons under eighteen (18) years of age. The Website is owned by S BELL Training.

S BELL TRAINING ONLINE SUBSCRIPTION 

Cancellation Policy

Your S Bell Training subscription will continue until terminated. Unless you cancel your subscription before your billing date, you authorise us to charge the membership fee for the next billing cycle to your Payment Method.

You can cancel your S Bell Training subscription once your minimum contracted term has been met, and you will continue to have access to the S Bell Training subscription through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial subscription periods or unused S Bell Training Subscription content. If you cancel your subscription, your account will automatically close at the end of your current billing period.

Safety Disclaimer

Physical exercise, in all of its forms and with or without the use of equipment such as the S Bell, is a strenuous physical activity. Accordingly, you are urged and advised to seek the advice of a physician before beginning any physical exercise regimen, routine, program or using any suggested equipment, shown in any of the video clips on the S Bell Training Website. S Bell Training is not a medical organisation and its instructors or staff cannot give you medical advice or diagnosis. All suggestions and comments relating to the use of equipment, exercises, moves and instruction are not required to be performed by you and are carried out at your election while viewing the S Bell Training online workouts. Nothing contained in this Website should be construed as any form of such medical advice or diagnosis.

By using the S Bell Training Website, you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in online workouts from the S Bell Training online subscription, you will not exceed your limits while performing such activity, as well as for any mental or physical conditions and/or limitations you have. You understand that the S Bell Training online workouts may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition. You expressly waive and release any claim that you may have at any time for injury of any kind against S Bell Training, or any person or entity involved with S Bell Training, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.

When participating in the S Bell Training online workouts ensure you always:

  • Check that you have adequate space to complete the workout and there are no trip/slip hazards
  • Check there are no objects you may fall on or come in contact with including no sharp objects or hot surfaces near by
  • Ensure your screen and other electrical appliances, including cables, are on a levelled surface and not in your training space causing a trip hazard
  • Ensure the room has sufficient ventilation
  • Ensure you have water to keep hydrated
  • Seek medical advice before training if you have any pre-existing injuries or other medical conditions

Limitation on Liability

In no event shall S Bell Training, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of content, (II) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Website, (III) any unauthorised access to or use of S Bell Training secure servers and/or any and all personal information and/or financial information stored therein, (IV) any interruption or cessation of transmission to or from the Website, (V) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the Website by any third party, and/or (VI) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the website, whether based on warranty, contract, tort, or any other legal theory, and whether or not S Bell Training is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that S Bell Training shall not be liable for content posted by users or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you. Any reference to a person, entity, product, or service on this Website does not constitute an endorsement or recommendation by S Bell Training or any of its employees. S Bell Training is not responsible for any third-party content on the Website or third-party web page accessed from this Website, nor does S Bell Training warrant the accuracy of any information contained in a third-party website or for any particular purpose. No communication of any kind between you and S Bell Training or a representative of S Bell Training shall constitute a waiver of any limitations of liability hereunder or create any additional warranty not expressly stated in the terms of use. S Bell Training reserves the right to remove any material posted on the Website that it determines in its sole discretion is violative of any law or right of any person, infringes the rights of any person, or is otherwise inappropriate for posting on the website.

PLACING ORDER’S ON THE S BELL TRAINING WEBSITE

Eligibility

By placing an order on the Website, you confirm that you are eighteen (18) years of age and you have full power, capacity and authority to agree to the Terms of Use.

 

Placing an order

You can place an order on the S Bell Training Website by navigating to the "See the Full Range" tab on the S Bell website and following the process for checking out once you have selected the products that you would like to purchase. When using the S Bell website, you may need to set your browser to accept both functional cookies and pop-ups in order to be able to use all the functionalities of the website, which includes adding items to your shopping cart and placing an order. If there are any errors in your order, please contact the S Bell team immediately at customercare@sbell.com.au.

After you have submitted an order by checking out on the S Bell Training website, we will send an email acknowledging receipt of your order to the email address that you have provided as part of the order. Once the products have been shipped, you will receive another email from our shipping partner to your email address confirming this ("Email Confirmation"). The Email Confirmation will be our acceptance of your order and the provisions of these Terms of Use will become binding on you and us in the form of a contract (the "Contract"). We suggest that you print a copy of these Terms of Use and the Email Confirmation for your future reference and records.

 

S Bell Training’s right to reject your order or cancel a Contract

S Bell Training expressly reserves the right to reject your order for any reason, in its sole discretion. Where your order has been rejected, you will not be charged for that order. S Bell also expressly reserves the right to cancel a Contract for the following reasons, without being liable for any damage or costs other than the repayment of the amount received from you in relation to the cancelled Contract:

    1. the ordered products are unavailable (including where they are not in stock);
    2. the billing or shipping information that you have provided is not correct or cannot be verified;
    3. based on our internal checks, your order is identified as an unusual order or an order that might be fraudulent;
  • the price that was displayed on the website for the relevant product was incorrect / erroneous
  •  

    Data checks

     

    S Bell Training may run some checks on any orders that you place on the Website, including verification of the delivery address and the payment details that you have provided. S Bell Training may also carry out checks for security reasons and to identify fraud. S Bell Training reserves the right to contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties if there is suspicious activity.

     

    PRICES AND PAYMENT

    Prices and currency

    The prices of products in an order will be at the prevailing prices displayed on the Platform when you check out. You will be able to verify the total price of your order prior to placing the order – this total price will include the price of all products as well as applicable shipping costs and taxes.

    While prices for products may change over time on the Website, these changes will not affect any orders that we have confirmed via an Email Confirmation.

    While all payments made on the Website for products that you order will be charged in Australian Dollars (AUD) and the invoice that you receive from S Bell Training will be denominated in AUD, you can choose to view the prices of products in your local currency on the Website. This conversion into your local currency is only for reference and may not always reflect the prevailing market currency conversion rate. Where the credit card or PayPal account that you use to pay for your order is denominated in a currency other than AUD, you may be charged administrative and/or currency conversion fees by the applicable bank or service provider – you acknowledge and agree that you will be responsible for any such fees and that the prices listed on the Platform excludes such fees.

     

    Payment methods and processing

    You will only be able to make payment for your orders using the methods set out on the order checkout page on the Platform – these methods include PayPal and credit cards. Please do not attempt to use any other payment methods as you may risk the loss of any payments made – S Bell Training will not be responsible or liable for any such losses.

    Upon submitting your order on the S Bell Training webpage, the PayPal account or credit card (as applicable) that you selected will be charged for the amount of the order (including the applicable shipping charges and taxes).

     

    Title transfer

    S Bell Training will retain the title in any products that you have ordered until full payment of the total price (including applicable shipping costs and taxes) has been received.

    SHIPPING AND DELIVERY

    S Bell Training will happily ship your orders for products within Australia and to certain locations around the world. 

     

    RETURNS 

    Returning orders after shipment

    Once an order has been shipped, you may exercise your statutory right of withdrawal by informing us of your desire to return the product within thirty (30) calendar days after the product is delivered to you. We require that your request to exercise a right of withdrawal is supported by proof of purchase (e.g., an invoice issued by S Bell Training). To exercise this right, please contact the S Bell team at customercare@sbell.com.au.

    In exercising your right to withdraw, you must return the products to us without undue delay (and at your own cost) and no later than thirty (30) calendar days after you have first informed us of your desire to return the product. Upon our receipt of the returned products, we will refund the purchase price and the original shipping costs through the payment method that you used in placing the order. 

    Please ensure that the returned products are complete (e.g., all original packaging, accessories and/or documentation must be intact) and not used in any way. If you do not do this and this results in a reduction in the value of the product, we can hold you liable for such diminished value.
